§ 1 Scope of Application

These General Terms and Conditions apply to all agreements concerning the rental of the holiday accommodation offered by Meik Barra, hereinafter referred to as the “Host”, to the guest. Any differing terms and conditions shall apply only if the Host has expressly agreed to them in text form.

§ 2 Conclusion of the Agreement

The presentation of the accommodation on the website is non-binding. The agreement becomes effective when the guest receives the booking confirmation from the Host by email. For bookings made through platforms such as Booking.com or Airbnb, the booking conditions confirmed on the respective platform shall also apply.

§ 3 Payment

Unless otherwise agreed, a deposit of 30% is due upon receipt of the booking confirmation. The remaining balance must be paid no later than 14 days before arrival. For bookings made within 14 days of arrival, the full amount is due immediately. The available payment methods are displayed during the booking process.

§ 4 Cancellation

Direct bookings may be cancelled free of charge up to 14 days before arrival. After this date, the following cancellation charges apply: 13 to 7 days before arrival: 50% of the total price 6 days or fewer before arrival, or in the event of a no-show: 90% of the total price Cancellations must be submitted in text form, for example by email. The guest may provide evidence that no loss or a substantially lower loss has been incurred. Any income received by the Host from re-renting the accommodation for the cancelled period shall be deducted from the cancellation charges. For bookings made through third-party platforms, the cancellation conditions stated on the respective platform shall apply.

§ 5 Use of the Accommodation and Damage

The accommodation may only be occupied by the number of guests stated in the booking. The house rules must be observed. Smoking, parties and unauthorised events are not permitted. The accommodation, furniture and furnishings must be treated with care. Any damage or defects must be reported to the Host immediately. The guest shall be liable for any damage caused through their fault in accordance with applicable law.

§ 6 Liability

The Host shall have unlimited liability in cases of intent or gross negligence and for damage resulting in injury to life, body or health. In the event of a slightly negligent breach of an essential contractual obligation, liability shall be limited to the foreseeable loss typically arising from such an agreement. Any liability required by law shall remain unaffected.

§ 7 Right of Withdrawal

There is generally no statutory right of withdrawal when booking holiday accommodation for a specific date or period. The agreed cancellation conditions shall remain unaffected.

§ 8 Final Provisions

The laws of the Federal Republic of Germany shall apply. Mandatory consumer protection provisions shall remain unaffected.
